Tim Epstein Provides Insight in New York Times Article

Tim Epstein, Chair of Duggan Bertsch's Sports Law & Litigation groups, explains why the governor of Pennsylvania is likely be granted standing to proceed with a lawsuit against the NCAA in an article published in the January 3, 2013 edition of The New York Times.

In the article, “Old Case Suggests Hard Road for a Governor’s Suit,” Tim examines the elements in a proposed lawsuit to support his believe that Gov. Tom Corbett of Pennsylvania will have the standing necessary to bring legal action against the NCAA on behalf of the state.

He explains that, unlike previous actions brought against the NCAA by third parties, the court will likely recognize Gov. Corbett’s the authority to bring a case on behalf of those he claims the NCAA injured financially when penalties were issued against Penn State.

“I think it would be difficult to argue that Corbett does not have standing to file here,” said Timothy Epstein, an expert in sports law, noting that Corbett was also a member of the university’s board of trustees. Penn State agreed to the NCAA penalties when they were handed down in July.
